What the FDA Found
According to the FDA, its inspectors found violations of federal manufacturing rules (cGMP) at both the company that distributes Balance of Nature and the company that made it. The FDA sent both warning letters in 2019.
The FDA said the products were made without setting required specifications for identity, purity, strength and composition.
The FDA said the company had claimed its products could be used to treat or prevent diseases such as cancer, heart disease, diabetes, asthma and COVID-19, which made them unapproved drugs under the law.
The government's complaint also alleged the company had no system for handling customer complaints, despite reports of possible allergic reactions to ingredients not listed on the labels.
Then a Federal Judge Stepped In
In November 2023, a federal court in Utah entered consent decrees of permanent injunction against Balance of Nature's distributor, Evig LLC, and its manufacturer.
Under the decrees, both companies had to stop manufacturing and distributing until they complied with federal manufacturing and labeling rules, hire outside experts, and get the FDA's approval to resume.
An FDA official said at the time that the companies had shown repeated violations of manufacturing requirements, and that the public could not be confident the products were what they claimed to be.
Balance of Nature agreed to the decree without admitting the allegations and said it was committed to full compliance. It's back on sale today.
